These Terms and Conditions form the agreement between you and Badal Umrah when you book a service through this website. Please read them before you book — by confirming a booking you accept them. If anything is unclear, ask us before you pay.

The short version

  • You are paying for an act of worship to be performed in Makkah on behalf of a person you name. You do not travel, and we do not arrange travel, flights, accommodation or visas.
  • You may cancel free of charge and receive a full refund at any time before the Umrah has been performed.
  • By confirming the booking you expressly ask us to begin at once and you acknowledge that, once the service has been fully performed and the proof delivered, the 14-day EU right of withdrawal is lost and the payment is no longer refundable.
  • If we cannot perform the service, you choose between a full refund and having it performed later at no extra cost.
  • Nothing in these terms takes away the rights that the consumer law of your own country gives you.

Who you are contracting with

The service is provided by Badal Umrah, an online-only business operated from Stockholm, Sweden, serving customers worldwide. Everything we provide is delivered digitally: there is no physical product, and nothing is shipped to you at any time.

In these terms, “we”, “us” and “our” mean Badal Umrah; “you” means the person placing the booking; “the beneficiary” means the person on whose behalf the Umrah or Hajj is performed; and “the service” means the act of worship performed on your instruction together with the proof of completion we deliver to you.

What the service is — and what it is not

You are engaging us to arrange for a vetted adult Muslim performer, already present in Makkah, to perform an Umrah — or, where you have booked it, a Hajj Badal — on behalf of the beneficiary you name, with the intention (niyyah) made specifically for that person, and to provide you with proof that it was carried out.

This is a religious service, not a travel service. We are not a travel agency, a tour operator or a visa agent. We do not sell flights, accommodation, ground transport or pilgrimage packages, we do not obtain visas or permits for you, and you do not travel anywhere. Nothing in this agreement constitutes a package travel contract under the EU Package Travel Directive or comparable national rules.

Our performers act on our behalf and under our instructions. We remain responsible to you for the proper performance of the service, whoever actually carries it out.

Who a Badal may be performed for

Badal — worship performed by proxy — is permitted in Islamic jurisprudence in defined circumstances. We accept bookings only where the beneficiary is:

  • A person who has died.
  • A person who is permanently unable to travel or perform the rites themselves because of old age, chronic illness or disability, with no realistic prospect of recovery.
  • A living, able-bodied person, but only where the booking is for a voluntary (nafl) Umrah and that person consents. An obligatory Hajj cannot be performed by proxy for someone who is able to perform it himself or herself.
  • Yourself, where you are booking an additional voluntary Umrah to be performed on your behalf and you understand that it does not discharge an obligation you are able to fulfil in person.

We follow mainstream scholarly guidance on these conditions and may decline a booking, with a full refund, where they are not met. Our performers perform Badal only after having performed Hajj or Umrah for themselves, in line with the requirement derived from the hadith of Shubruma.

Booking and acceptance

You place a booking by selecting a package, completing the booking form with the beneficiary's details and any du'a or special wishes, and paying the price shown at checkout. Your submission is an offer to purchase, not yet a contract.

A contract comes into existence when we send you a booking confirmation by email. If we cannot accept your booking — for example because the eligibility conditions above are not met, because the information you gave is incomplete or inconsistent, or because we cannot perform within a reasonable time — we will tell you and refund in full anything you have paid.

You are responsible for the accuracy of what you submit, in particular the beneficiary's name and status. Tell us immediately if you notice a mistake: we can correct details at any point up to the moment the Umrah is performed, but not afterwards.

Prices, currency and taxes

Prices are set in US dollars and may be displayed in your local currency using an indicative exchange rate for convenience. The amount presented on the final checkout page, in the currency named there, is the amount that will be charged.

Your bank or card issuer may apply its own exchange rate or a foreign-transaction fee if it settles in a different currency. Those charges are a matter between you and your bank; we do not receive them and cannot refund them.

Prices include any tax we are required to charge, shown separately where applicable. If you are outside Sweden you are responsible for any local tax, duty or charge that applies to you. We may change our prices at any time, but never for a booking we have already confirmed.

Payment

Payment is taken at the time of booking through Stripe, using the payment methods shown at checkout. We do not receive or store your card details. Our Privacy Policy explains how payment data is handled.

If a payment fails, is declined or is reversed, no contract comes into effect and we are under no obligation to perform. If a payment is charged back after we have performed the service and delivered the proof of completion, we may provide the payment provider with that evidence of performance.

Cancellation, right of withdrawal and refunds

This is the most important section of these terms, so please read it carefully. Because an act of worship cannot be undone, returned or resold once it has been carried out, our refund rule turns on a single question: has the Umrah been performed yet?

  • (a) Before performance — free cancellation, full refund. You may cancel at any time before the Umrah has been performed, for any reason or for none, by emailing us with your booking reference. You receive one hundred per cent of what you paid, with no cancellation fee and no deduction.
  • (b) Your express request and acknowledgement. When you confirm a booking you make the following declaration: “Free cancellation any time before the Umrah is performed. By confirming, you ask us to begin as soon as possible and accept that the payment is not refundable once it has been performed.” This declaration forms part of these terms, and by accepting these terms at checkout you give that express request and that acknowledgement. The declaration is displayed to you in full on the confirmation step before you accept, we record the date and time at which you accept it, and we repeat it back to you in your booking confirmation email.
  • (c) After performance — no refund. Once the Umrah has been fully performed and we have delivered the proof of completion, the service has been fully supplied, your right of withdrawal is extinguished and the payment is not refundable. This follows Article 16(a) of Directive 2011/83/EU on consumer rights and the corresponding provision of the Swedish Distance Contracts Act (distansavtalslagen).
  • (d) If we cannot perform — your choice. If we are unable to perform the service, or we perform it materially otherwise than as agreed, you choose between a full refund and having the service performed again, correctly, at no additional cost to you.

Approved refunds are returned to the original payment method within fourteen days of our accepting the cancellation. How quickly the money appears on your statement then depends on your bank or card issuer.

Nothing in this section limits your statutory rights if the service was not performed at all, was not performed as described, or was not performed with reasonable care and skill. If you believe something has gone wrong, tell us — see the section on complaints below.

If you are a consumer outside the EU or the EEA and the mandatory law of your country of residence gives you a cancellation right that is more generous than this section, that law applies to you and this section is read subject to it.

Delivery of media and certificate

The service is delivered digitally. Depending on the package you chose, you receive photographs from the Haram, video clips, a personal completion certificate naming the beneficiary, and written confirmation of the date on which the Umrah was performed. We deliver these through a private link sent to the email address on your booking.

We aim to perform within the timeframe stated on the package page and to deliver the proof within a few days of performance. Timing can be affected by conditions in Makkah — crowding during Ramadan and the Hajj season, weather, and access rules set by the Saudi authorities. We will keep you informed of any significant delay, and a delay never prevents you from cancelling for a full refund while the Umrah has not yet been performed.

Your responsibilities and warranties

By placing a booking you confirm that:

  • You are at least eighteen years old and legally able to enter into this contract.
  • The information you give us about yourself and about the beneficiary is accurate and complete.
  • You are entitled to share the beneficiary's name, status, your relationship to them, any photograph and every other detail you submit, and that where the beneficiary is living and capable of understanding, they know about the booking and agree to it.
  • You will not submit content that is unlawful, abusive, defamatory or that infringes anyone's rights, and you will not upload a photograph you do not have the right to use.
  • You are not using our service to launder money, to evade sanctions, or for any other unlawful purpose.

You agree to indemnify us against any claim brought by a third party arising from information you supplied to us in breach of these warranties. We may refuse or cancel a booking, with a full refund, where we reasonably believe that any of these confirmations is untrue.

Intellectual property

We own, or are licensed to use, the website and its text, design, photographs, logos and software. You may not copy, scrape, resell or republish any of it without our written permission.

The photographs, video and certificate produced for your booking are licensed to you for your personal and family use: you may keep them, print them and share them privately for as long as you wish. We retain copyright in the material we created. We will not use media that identifies your beneficiary in our marketing without your separate, specific consent.

Limitation of liability

We perform the service with reasonable care and skill and take our responsibility to you seriously. Subject to the exceptions below, our total liability to you arising out of or in connection with any booking is limited to the amount you paid for that booking, and we are not liable for indirect or consequential loss, loss of profit, loss of data or loss of opportunity.

Nothing in these terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot lawfully be excluded or limited, including the non-excludable rights that consumer protection law gives you.
  • Our obligation to refund you under the cancellation section above.

We are not liable for loss you suffer because information you gave us was incorrect, or because you passed your private delivery link to someone else.

Religious disclaimer

We perform the Badal in accordance with mainstream scholarly guidance, with the intention (niyyah) made specifically for the beneficiary you named, by a performer who has already completed the rites for himself. We take that trust seriously and we describe honestly and accurately what we do.

We cannot and do not guarantee any spiritual outcome. Acceptance of any act of worship is from Allah alone. Nothing on our website, in our communications or in your certificate should be read as a promise of reward, forgiveness, healing or any particular result, and no refund is available on the basis that a spiritual outcome was not observed.

Force majeure

We are not in breach of these terms, and we are not liable for delay or failure to perform, where the cause lies beyond our reasonable control. This includes restrictions, closures, permit rules or quota decisions imposed by the authorities of the Kingdom of Saudi Arabia, suspension of Umrah or Hajj, epidemics and public-health measures, war, civil unrest, natural disaster, extreme weather, and failures of payment, communication or hosting infrastructure.

If a force majeure event prevents performance for more than sixty days, either of us may cancel the booking, and we will refund you in full for any service that has not yet been performed.

Complaints and dispute resolution

If something has gone wrong, please email us first with your booking reference and a description of the problem. We acknowledge complaints within three business days and aim to resolve them within fourteen days. Almost every matter is settled at this stage.

If we cannot reach agreement and you are a consumer in the EU or EEA, you may refer the dispute to an approved alternative dispute resolution body. The European Commission's Online Dispute Resolution platform previously provided a single entry point for this; since that platform was discontinued in July 2025, EU and EEA consumers should approach a national dispute resolution body directly.

You may bring the matter to the Swedish National Board for Consumer Disputes — Allmänna reklamationsnämnden (ARN), Box 174, 101 23 Stockholm, Sweden, arn.se — free of charge. We take part in ARN proceedings and follow its recommendations. None of this affects your right to bring the matter before a court.

Governing law and jurisdiction

These terms, and any dispute or claim arising out of them or their subject matter, are governed by Swedish law, and disputes may be brought before the Swedish courts.

If you are a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you habitually reside, and you may also bring proceedings in the courts of that country.

Changes to these terms

We may update these terms as our service, our providers or the law change. The version published on this page at the moment you confirm a booking is the version that governs that booking, and we keep a record of it.

Changes never apply retroactively to a booking we have already confirmed.
